OPEN WORK PERMIT

OPEN WORK PERMIT is a visa which allows the spouse of main applicant to accompany him or her while the main applicant is studying in any country. But while in countries like Australia & UK, the main applicant and his/her spouse can apply together during the study visa application of the main applicant.

Here is the list of the countries & their requirements for which you can apply from us –

AUSTRALIA DEPENDANT VISA

In Australia spouse is generally referred as dependent. It can be great choice for the partners who want to travel together at first instance.

But several conditions apply as listed below –

Conditions:-

  • Student & the spouse can only apply together under SUBCLASS 500 Student Visa, if the main applicant is already a graduate and will be pursuing a master degree in Australia. As a part of the visa conditions, the main applicant will do the studies on full-time basis and can only work part-time for up to 20 hours per week while the spouse can work full time.
  • But if the main applicant has done Grade 12 and will be pursuing a bachelor degree course in Australia. Then according to our experience with Australian immigration process, the chances of getting visa in this stage is low and can also effect main applicant so we recommend the main applicant to apply first and then the spouse can join him/her in Australia after sometime as subsequent entrant.

About Subclass 500 Subsequent Entrant

Under this category, the spouse of main applicant can join him/her in Australia after sometime when he or she is studying in Australia. And he/she will get the same duration of visa which the main applicant have pending in Australia. You as a spouse can work full time if the main applicant is pursuing a master degree in Australia but if the main applicant is pursuing a bachelor degree then you can only work for 20 hours a week until the main applicant finishes her study and applies for next study visa for master degree or apply for a Post Study Work Permit.

Requirements

You need to meet several requirements even if you are applying together for Australia or if your spouse is applying after sometime as subsequent entrant.

  • You must have a genuine relationship.
  • You and your spouse must meet health & character requirements.
  • You as a spouse should have adequate health insurance or OSHC for entire duration of stay in Australia
  • Proof of financial capacity to meet the living expenses in Australia
  • Strong financial ties & incentives which leads you to return to home country after visa expiry.

Processing Fees

If Applying together-
Then you need to pay additional applicant charges AUD 460 apart from the charges of main applicant.

If Applying as a subsequent entrant –
Then you need to pay AUD 620 as your visa application processing fees.

OPEN WORK PERMIT CANADA

map In Canada, the visa application of spouse is generally referred as open work permit which allows the spouse of student to join him/her in Canada while he/she is studying in Canada.

Specifically, an OPEN WORK PERMIT is not a job so specific Job offer letter is not required for this and it allows spouse to work openly anywhere in Canada. On the Contrary, some people always have a doubt in work permit and open work permit whereas, there is a huge difference between these two categories.

Can we apply together for Canada?

In Canada, spouse and main applicant cannot apply together during the student visa application of the main applicant. But spouse can accompany the main applicant after 3 or 6 months in Canada on open work permit.

Requirements

The spouse or common-law partner may be eligible for an open work permit if the main applicant:

  • have a valid study permit and
  • is a full-time student at one of these types of schools:
    • a public post-secondary school, such as a college or university, or CEGEP in Quebec
    • a private college-level school in Quebec
    • a Canadian private school that can legally award degrees under provincial law (for example, Bachelors, Masters or Doctorate degree)

Apart from these requirements, you should also need to show that you both have genuine relationship and you as a spouse are meeting health & character requirements. Along with that you (referred for spouse) also need to show proof of financial resources which presents strong ties to the home country.

Visa Duration

Under this category of visa, you will get the same duration of visa which the main applicant have pending in Canada.

Processing Fees

You need to pay - $100 as open permit holder fee, $155 work permit fees & $85 biometric fee, which in total becomes $340 as a processing fees for Open Work Permit of Canada.

NEW ZEALAND

PARTNER OF STUDENT WORK VISA*

map New Zealand allows partners or spouse of the student visa holders studying in New Zealand to accompany them in NZ if they are studying towards a Level 7 (Bachelor Degree or Graduate Diploma) or 8 (Bachelors with honours/Post Graduate Diploma) Qualification on NZ Long Term Skill Shortage List, or a Level 9 (Master Degree) or 10 (PhD) qualification. Under this category, partners will get the visa for the same duration of the main applicant student visa is valid for. There is no job offer letter required from NZ employer to apply for this visa and this visa allows you to work for any employer at any job in NZ after approval.

Requirements

You as a partner, need to meet several requirements as listed below in order to apply for this partner work visa.

  • You must be in a good health.
  • You intentions of visiting NZ must be genuine which will states that you are entering NZ on temporary basis & will leave NZ when visa get expired.
  • You must have genuine relationship with your partner and need to provide evidence for it
  • Your partner must be eligible to support your application
  • You and your partner must be of good character
  • Proof of enough financial capacity for meeting living expenses of NZ

Visa Processing Fees

The visa application fees will cost you around $495 under this category along with INR 747 as passport service fees.

UK SPOUSE VISA

map UK also allows the spouse of the main applicant to apply together under General Student Visa (TIER-4) Application. But it can be only possible if the main applicant is sponsored by a higher education institution on a course at level 7 (equivalent to master degree) on the Ofqual register or above that lasts for the duration of 9 months or more. There is no job offer letter required from UK employer to apply for this visa and it allows you to work for any employer at any job after approval. And you will get the same duration of visa as of the main applicant gets.

Requirements

  • a current passport or other valid travel documentation
  • proof that you can support yourself while your stay in UK
  • proof of genuine relationship with your partner
  • your tuberculosis test results reports from panel physicians

Processing Fees

You need to pay £375 per applicant as a processing fees for this visa along with £300 for healthcare surcharge.
